You are a newly hired police officer, and you have just been released from you

You are a newly hired police officer, and you have just been released from your department’s field training program, which means you are riding solo in your own patrol car. Under the terms of your probationary employment, you may be terminated for any reason until after you have been employed for 1 year. After 1 year, your employment becomes protected by civil service.
While you are on routine patrol, you notice that some of your colleagues are regularly conducting pretextual traffic stops on minority drivers to search for illegal drugs. After the officer’s conduct pretextual traffic stops, they will search the minority drivers and their cars—frequently without consent—or the officers will use implied consent to search (based on fear). By doing this, the officers are frequently successful in finding illegal drugs, which are then used to arrest the drivers. This search methodology appears to be systemic in the department. Discuss the following regarding this scenario:
What are the Fourth Amendment protections for drivers and their vehicles during traffic stops?
Explain the difference between racial profiling (illegal) and criminal profiling (legal).
Define what pretextual traffic stops are. What is the U.S. Supreme Court’s ruling on pretextual stops?
What is the difference between reasonable suspicion and probable cause?
Can someone be detained based on reasonable suspicion? If so, for how long?
Can someone be arrested based on reasonable suspicion? What is the plain feel doctrine?
Describe under what conditions an officer may search a vehicle, specifically when the owner declines authorization for an officer to search it.
As a probationary police officer who can be legally terminated without cause during your first year of employment, how would you handle this kind of a situation, if you discovered it to be systemically happening?

Labeling theorists are adamant about the labels that offenders are given throughout the criminal justice system. Labels, such as ex-felon, are deepening the very behavior that they are meant to halt because of stereotypes that incite an individual trying to recover after a prison term. The labeling theory argues that the criminal justice system is limited in its capacity to restrain unlawful conduct but also is a major factor in anchoring people into criminal careers.
The cultural deviance theory explains that the causes of criminal behavior in urban areas are not about the poverty suffered in those areas but the product of a distinct lower-class culture whose focal concern is deviance against the norms of society.
The theory has identified three influential versions, as follows:
The lower-class culture as a whole is responsible for generating crime in urban areas
Urban lower-class areas produce subcultures that are responsible for the rise of crime
Subcultures of crimes in urban areas where individuals band together in creating crimes for their own personal gain and satisfaction
Assignment
What would be another theory and strategy to avoid stereotyping individuals in the criminal justice system?
Is labeling theory a legitimate crime causation theory? Why?
In your opinion, where do gangs fit within the 3 influential versions of cultural deviance theory? Why?
Decide whether labeling theory or cultural deviance theory best explains the following problem, and why:
The number of youths joining gangs in the inner city has doubled, while the number of gang leaders serving time in prison and being released after good conduct has increased. The crime rate for gang violence has risen 20% from last year.

Important Guidelines
Your score will be determined using the Critical Legal Thinking Case Study Rubric. Please read this rubric thoroughly before attempting this assignment.
Your score will be determined by the evaluation of your substantive content. Your analysis and solutions must be based on the principles of law, ethics, and business—not on your opinions. You must describe how the application of the principles to the key facts supports your determination of the issues. In other words, you need to show the reasoning behind your decision.
Key facts are those facts that determine if the principles of law are met. You must demonstrate that you recognize the key facts in this case. List the key facts individually. Do not simply repeat or retype the factual scenario.
The length of your response has no bearing on your score. There is no minimum or limit, however, most responses will be between two and three substantial pages.
Roger is a director of a major car manufacturer. This is one of the few remaining car companies yet to introduce a sport utility vehicle. Roger convinces the board to investigate forming a new division to design, build, and market a sport utility vehicle. Roger also convinces the board that the first sport utility vehicle that the division introduces should be the largest yet sold to the general public.
The board set up a committee to do some research, and this committee hired a marketing consulting firm. The committee and the consulting firm both had a few reservations about such a large vehicle, but the data showed that the market could most likely support it. After much discussion, the board of directors voted in favor of creating the new division and the huge sport utility vehicle as its first product. The vote was 9 to 6 in favor of the plan.
Shortly before this vehicle was introduced, there was a major oil supply disruption that caused the price of crude oil to nearly triple. Few purchasers were found for the huge new sport utility vehicle and the company lost considerable money. A shareholder files suit against Roger claiming he violated his duty to the corporation by convincing the board to build and market the large SUV.
Discuss Roger’s duties as a director and any defenses he has to the lawsuit.

In this unit, you are studying the judicial branch of government and the rules that apply to all cases that are filed with a court, such as jurisdiction and the justiciability doctrine. With these rules in mind, analyze the following fact patterns.
Billy, a resident of Dallas, Texas, was having trouble paying his bills. Billy, along with his best friend Edward, decided that they would rob a bank in neighboring Wichita Falls to raise some funds. During the robbery, things went horribly wrong, and Billy and Edward ended up taking a hostage and driving to nearby Randlett, Oklahoma, where they took refuge in Edward’s grandmother’s home. Both Billy and Edward eventually were apprehended in Randlett, and the hostage was released. Which court would possess jurisdiction over this case—state or federal? Explain your answer.
Newlyweds Malia and Kevin were honeymooning in Hawaii. They were on their way to a Hawaiian luau when they were rear-ended by a local resident who lived in Honolulu. Malia and Kevin were both hospitalized and required extensive surgery for back and neck injuries. Malia and Kevin wish to sue the local resident. Which court would possess jurisdiction over their cases—state or federal? Explain your answer.
Jane recently discovered that she is pregnant. When she shared the happy news with her coworkers at a local law firm, everyone was overjoyed—especially her good friend, Chiquita. Unfortunately, the very next week, Jane was fired from her position, despite receiving stellar annual reviews. Her supervisor said that they were downsizing because they had lost a big case. Jane believes that she was fired because she is pregnant. Jane does not want to call any attention to her firing, so she has decided not to do anything about the firing; however, Jane’s friend Chiquita, who is a paralegal, is furious with the attorney. She has decided to file the case on behalf of her friend, Jane. In what court would this case be filed—state or federal? Would Chiquita face any problems with filing the lawsuit? If so, what? Explain your answer.
In a 2 page paper, answer the questions associated with each fact pattern, and also complete the following:
Identify the federal district in which you reside and the specific district, such as the Northern District of Alabama, the Middle District of Alabama, or the Southern District of Alabama.
Identify the branch of government that created these lower courts.
Review the Web site for your local state circuit court and your local federal. district court, and provide the citation to each.

In 2 pages, provide a guide for using the intake form for stalking or other crime victims.

As a victim advocate, your best friend became a victim of a crime of violence after being stalked for several months, and that incident changed your life. You provided comfort and support to your friend during the judicial process and you guided that friend through the criminal judicial process. Your efforts were successful in obtaining the help needed and criminal justice outcomes desired by your friend.
The new prosecutor for whom you have been working as a victims’ witness assistant has had several calls from victims of stalking. Some cases seem more serious than other cases; however, one case that no one in the office thought was serious resulted in the victim’s death. Everyone thought that the couple was just going through a difficult breakup. This case had a tremendous impact on the entire office, especially you.
To help make sure that the office does not minimize a potentially dangerous situation again, the prosecutor has asked you to put together an intake, evaluation, and assessment instrument to be used in taking information on stalking situations. Be sure to check stalking statutes, and cite the elements of the crime of stalking in your documents.
In 2 pages, provide a guide for using the intake form for stalking or other crime victims.
Create a 2 page topic paper  in APA format discussing the following:

Importance of recognizing the signs of stalking
Criminal definition of stalking for your jurisdiction (cite a relevant stalking statute)
Key facts that you felt all office personnel should know about stalking, such as the remedies designed to help a stalking victim

However, it has provided literally millions of potential victims of crime.

Computer technology has provided the criminal justice system with a number of benefits such as program algorithms that identify scanned fingerprints and facial recognition. It has increased intelligence and record keeping capabilities. However, it has provided literally millions of potential victims of crime. It started out with financial crimes (such as fraud and ransom software), and it progressed to luring victims to locations for murder, rape, and kidnapping. Victims of computer crimes include the criminal using social media as a weapon.
The commander of a newly formed cyber-crime unit is very knowledgeable about fraud and various financially motivated viruses. The one thing he is not that familiar with is the impact that social media has on victims of crimes such as cyber bullying and cyber stalking.
The commander has you temporarily attached from the human trafficking and sex crimes unit to bring his cyber teams up to date on how to understand what cyber victims of stalking and bullying are going through and how best to approach them for maximum effective investigation.
Devise a plan on explaining the aspects of cyber bullying and cyber stalking to the cyber-crime unit.
Focus your discussion on the following:
Identify three social media websites and explain how they are used to carry out cyber stalking and cyber bullying crimes.
Explain why comments made on social media are so impactful on the emotions of the victim.
Identify the types of cyber-crimes that may ultimately lead to a physical crime against the victim
Advise the cyber-crime unit team members on what types of assurances should they provide the victim to obtain his or her cooperation in the investigation and to ultimately keep him or her safe.
